Terms & Conditions

1. Agreement

These Terms & Conditions are between you and Abd Studios Inc, a company based in Baghdad, Iraq, trading as Hyperdrive 3D! (the "Seller", "we", "us"). By accessing or using the Hyperdrive 3D! game and website (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Hyperdrive 3D! is a browser-based 3D racing game featuring virtual vehicles, in-game coins, levels, leaderboards, and clubs. Virtual items (coins, cars, badges, passes) have no real-world monetary value, cannot be exchanged for cash, and are licensed — not sold — to you.

3. Accounts

You must provide accurate information when creating an account, keep your credentials confidential, and are responsible for all activity under your account. You must be of legal age in your jurisdiction or have permission from a parent or guardian. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations.

4. Acceptable use

You must not misuse the Service. Prohibited conduct includes:

• Unlawful use, fraud, or spam
• Infringing intellectual property rights
• Interfering with security or infrastructure (malware, probing, scraping, denial of service)
• Cheating, exploiting bugs, or manipulating leaderboards
• Reverse engineering, reselling, or redistributing the Service
• Circumventing technical limits or payment systems

5. Intellectual property

The Service, including its software, artwork, music, documentation, and branding, is owned by Abd Studios Inc and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for personal, non-commercial play within your selected plan. If you submit content (e.g. nicknames, club names, avatars), you grant us a limited license to host and process it solely to provide the Service.

6. Payments & subscriptions

Purchases are sold by Abd Studios Inc and processed through our Shopify checkout. Shopify handles payment processing and order receipts; we provide customer support and handle returns.

Prices are shown at checkout and include any applicable taxes where required. The Supporter Pass is a one-time purchase covering 30 days of benefits and does not auto-renew. See our Refund Policy.

7. Service level & warranties

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the fullest extent permitted by law, Abd Studios Inc is not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury where required by law.

9. Termination

On termination, your access to the Service and virtual items ends. We may retain or delete account data as described in our Privacy Notice.

10. General

These Terms are governed by the laws of the Seller's jurisdiction. We may update these Terms; continued use of the Service constitutes acceptance of the updated Terms. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control.
